This Privacy Policy ("Privacy Policy") describes the types of information that Toshiba America, Inc. ("TAI", "us" or "we") may collect or you may provide when you visit the websites located at www.toshiba.com/tai, www.toshiba.com/csr, www.toshiba.com/tari, and news.toshiba.com (collectively, our "Websites"), including the web pages located at the web addresses that begin with the same subdomain, domain name, and path as any of the Websites. It also explains TAI’s practices regarding the collection, use, disclosure, storage, and protection of that information.

For the avoidance of doubt, this Privacy Policy would apply to web pages located at the following web addresses:

This Privacy Policy also does not apply to information collected by TAI’s affiliates ("TAI Affiliates"). TAI’s Affiliates include, but are not limited to, TAI’s parent company (i.e., Toshiba Corp.), TAI’s subsidiaries, or other companies controlled, directly or indirectly, by Toshiba Corp. TAI Affiliates may have their own privacy policies covering their respective information-gathering and data-sharing practices, whether used in connection with their websites or otherwise.

Please read this Privacy Policy carefully to understand our practices regarding your information and how we will treat it. If you do not agree with our practices, your choice is to not use our Websites. Children's Privacy

Our Websites are not intended for children under 18 years of age. No one under the age of 18 may provide any information to or on the Websites. TAI does not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on our Websites or through any of their features, register on the Websites, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use.

Links to Third Party Web Sites

The Websites may contain links to third party websites, including TAI Affiliate’s websites, Toshiba co-branded websites, or other third party websites. Third party websites are not operated by us, and we are not responsible for the information security and privacy practices of such third parties, nor are we responsible for the content on such third party websites. The practices of third parties, including those used in connection with their websites, are not covered by this Privacy Policy. To the extent such third parties have their own privacy policies, you are responsible for reviewing them to learn how they handle your information.

Types and Sources of Information We Collect

We collect several types of information from and about our Websites' visitors, including:

Information We Automatically Collect. When you visit any of our Websites, we may automatically collect the following information:

• Identifiers. Your Internet Protocol address.
• Internet or other electronic network activity information. The website from which you navigated to our Website, information about your interaction with our Website, the computer, operating system, and browser you use to access our Website, and similar internet usage and connection details.

Information You Provide To Us: When you submit a form through any of our Websites, you may provide us with the following information:

• Identifiers. Your first and last name, e-mail address, and cell phone.
• Professional and Employment-Related Information. Your profession, title, news media badge and other media credentials, media beat, company name, company physical address, company fax number, and the URLS of your company’s blog and social network profile pages.
• Commercial Information. The types of services or products that you would like to receive and content you have bookmarked.

Information We Obtain From Service Providers. We engage third parties to collect information using "cookies" alone or in combination with other industry standard technologies (e.g., clear GIFS, web beacons, pixel tags, and JavaScript tags) to generate statistics or measure and analyze website activity (including, but not limited to, page usage, paths followed during visits through our Websites, and the geographical location of visitors).

How We Use Information We Collect

Use of Your Personal Information. We use your personal information for the following purposes:

• To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our Websites’ users is among the assets transferred.

To market products and services to you, we may combine information we collect online about you with other information you provide to us through other sources, including, but not limited to, sweepstakes and surveys, and with data from third parties.

Use of Public or Non-Personal Information. In addition, subject to applicable law, we may use non-personal information without restriction.

Our Disclosure of Information We Collect

Disclosure of Your Personal Information. We may disclose personal information that we collect or you provide as described in this Privacy Policy to:

• TAI Affiliates
• Contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
• A buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of TAI's divisions or assets (whether as a going concern, as part of bankruptcy, liquidation, or similar proceeding, or otherwise) in which personal information held by TAI about our Websites' visitors is among the assets transferred.

We may also disclose your personal information to law enforcement, companies, and organizations to respond to law enforcement requests, to protect against fraud, or if TAI reasonably believes it is appropriate to do so to protect TAI, its customers, or the public. In addition, TAI may disclose your personal information as required by applicable law, court order, or governmental regulations.

Disclosure of Public or Non-Personal Information. Subject to applicable law, we may disclose without restriction any public information about you, aggregated information about our users, and information that does not identify any individual.

Data Processing and Cross-Border Data Transfers

The Websites are maintained on servers located in the United States, and personal information submitted through any of our Websites is stored on our servers in the United States. If you are visiting a Website from outside the United States, please be advised that your information is transferred to our servers located in the United States. Disclosing your personal information to us on or through any of our Websites is at your own risk. We strive to comply with the laws of jurisdictions in which we maintain operations, but we make no representations that the practices described in this Privacy Policy are compliant with privacy and information security laws outside of those jurisdictions.

Your Opt-Out Choices

Marking Emails. You may opt out of receiving marketing information from us by unsubscribing to receiving such information using the "unsubscribe" or similar link on any of the marketing emails you receive from us. We will try to process such opt-out request within 10 business days. Please note, however, that even if you opt out of receiving our marketing information, we may still send you certain types of communications, such as transactional or legal notification emails, and we may respond to your requests by email.

Tracking Technologies. You can delete or set your browser to refuse all or some browser cookies, or you can set your browser to alert you when cookies are being sent. Please refer to your browser’s instructions to learn more about your browser settings and how you can manage cookies. Personal Information Processing. If you request that we stop processing your personal information, we will do so in our discretion, subject to applicable law. Without limiting the foregoing, we will not delete information that we are required to retain for our business operations or legal compliance unless the law requires us to do so. For your protection, we may require that you provide adequate identification information or documentation before we comply with your request. Unless otherwise required by applicable law, we will respond to such requests within 20 days of our receipt of your request and any information or documentation that we request to confirm your identify. Please note that, if permitted under applicable law, we may charge you a fee of US$20.00 to meet our cost associated with terminating our processing of your personal information, or to provide you with information about the personal information that we collect about you.

California Residents: Your California Privacy Rights

This “California Residents: Your California Privacy Rights” section applies only to California residents. In addition, the California Consumer Privacy Act of 2018 (“CCPA“) temporarily exempts, from some of its requirements, employment-related personal information that a business collects from its California-based employees, job applicants, contractors, or similar individuals (“collectively, “employee personal information”), and personal information about California residents reflecting a written or verbal business-to-business communication (”B2B personal information”). Accordingly, this “California Residents: Your California Privacy Rights” section does not cover or apply to employee personal information or B2B personal information.

Under the CCPA, California residents have the following rights regarding TAI’s collection, use, and sharing of their personal information

• Right to Request Access to Information. You have the right to request that TAI disclose to you the personal information that TAI collects, uses, and discloses about you. Specifically, you have the right to request that TAI disclose the following to you:
• The categories of personal information we have collected about you.
• The categories of sources of the personal information we have collected about you.
• The business or commercial purpose(s) for collecting personal information.
• The categories of third parties with whom we share personal information.
• The specific pieces of personal information we have collected about you.
• The categories of personal information we have disclosed about you for a business purpose.
  

  The disclosure covers the 12-month period preceding TAI’s receipt of your verifiable request, and you may only make a request for information twice within a 12-month period.

• Right to Request Deletion. You have the right to request that we delete your personal information, though exceptions under the CCPA may allow TAI to retain and use certain personal information notwithstanding your deletion request.
• Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights. You have the right to not receive discriminatory treatment by TAI for the exercise of the privacy rights conferred by the CCPA.

No Sales of Personal Information. TAI does not sell your personal information and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale as required by law. Similarly, we do not offer financial incentives associated with our collection, use, or disclosure of your personal information

Exercising Access and Deletion Rights. To exercise the access and deletion rights described above, please submit a verifiable request to us by either:

• Calling us toll free at (877) 323-0017; or
• Emailing us at TAI-privacy@toshiba.com and including “CCPA Request” on subject line.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

The verifiable consumer request must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative of that person, including your full name, physical address, telephone number and email address.
• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot (a) verify your identity or authority to make the request, and (b) confirm the personal information relates to you or the person on behalf of whom you are making the request. Making a verifiable consumer request does not require you to create an account with us.

Other California Privacy Rights. Separate from the CCPA, California’s Shine the Light law gives California residents the right to ask companies what personal information they share with third parties for those third parties’ direct marketing purposes. We do not disclose your personal information to third parties for the purpose of directly marketing their goods or services to you.

Information Security

TAI takes steps to protect information contained in our systems against misuse, loss or alteration. Keep in mind, however, that no method of transmission over the Internet or electronic storage is 100% secure, and any information that you send to us by email may not be protected. While TAI strives to protect your personal information, we cannot guarantee or warrant the security of any information you transmit to us, and any transmission of information is at your own risk.

The safety and security of your information also depends on you. If you create a password to access certain parts of our Websites or to obtain certain services related to the Websites, you are responsible for keeping the password confidential. You should not share it with anyone, and you must notify us immediately if you become aware of any unauthorized access to, or use of, your username/email or password in connection with any of the Websites. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

Notification of Changes

From time to time, we may choose to change our privacy practices and this Privacy Policy. We will notify you of material changes to the Privacy Policy by posting a revised Privacy Policy on, or that is accessible through, the Websites, and such revised Privacy Policy will have an updated effective date at the top of the document. Any updates, revisions, supplements, modifications or amendments to this Privacy Policy shall be effective immediately upon its posting on, or it being made accessible through, the Websites, and the same will only be applicable to disputes arising after such posting has been made or access has been provided. You agree that you will continue to be bound by this Privacy Policy, however and whenever it is updated, revised, supplemented, modified, or amended, if you continue to use any of the Websites after the updates, revisions, supplements, modifications or amendments have been posted or made accessible.
