The Imaging Systems Division of Toshiba
America Information Systems, Inc. ("ISD"),
makes the following limited warranties. These limited
warranties extend to the Original End-User ("Your[r]").
Refurbished product has been inspected for operation,
features and functions. Refurbished product is inspected
to be in "like new" condition, but may have
minor cosmetic flaws and may not contain all accessories.
Accessories can be obtained by contacting the ISD authorized
parts distributor. Please review the web site for information
on purchasing accessories.
Thirty (30) Days Limited Warranty of Labor
and Parts
ISD warrants that this product will perform
in accordance with specifications for a period of thirty
days from the date of purchase by the Original End-User.
During this period, ISD will repair or replace with a
new or refurbished unit a defective product or part,
without charge to user. User must deliver the entire
product to an ISD authorized service center. User is
responsible for all transportation and insurance charges
for the product to the Service Center. ISD reserves the
right to substitute factory refurbished parts in place
of those in need of repair.
Instruction Manual (Owner's Manual)
User should read the instruction manual
(owner's manual) thoroughly before operating this product.
Prior to seeking service, be sure to review the troubleshooting
guide in the owner’s manual and the frequently
asked questions on the ISD Web site for instructions
to correct the problem.
Your Responsibility
The above warranties are subject to the
following conditions:
1.
You
must retain the bill of sale or provide other proof
of purchase.
2.
User
must notify ISD service within thirty (30) days
after user discovers a defective product or part.
3.
All warranty
servicing of this product must be made by ISD authorized
service center.
4.
These
warranties are effective only if the product is
purchased and operated in the U.S.A.
5.
Labor
service charges for installation and adjustments
of customer controls are not covered by the warranty.
6.
Warranties
extend only to defects in materials or workmanship
as limited above and do not extend to any products
or parts which have been lost or discarded by user
or to damage to products or parts caused by misuse,
accident, improper installation, improper maintenance
or use in violation of instructions furnished by
us; or to units which have been altered or modified
without authorization of ISD or to damage to products
or parts thereof which have had the serial number
removed, altered defaced or rendered illegible.
Step-By-Step Procedures - How to Obtain
Warranty Service
To obtain warranty servicing, user should:
1.
Verify operation of the unit by
checking the instruction manual (owner's manual).
2.
Contact ISD authorized service center
for warranty service within thirty (30) days after
user finds a defective product or part.
3.
Arrange for the delivery of the
product to ISD authorized service center. Products
shipped to the service center must be insured and
safely and securely packed, preferably in the original
shipping carton, and a letter explaining the defect
and also a copy of the bill of sale or other proof
of purchase must be enclosed. All transportation
and insurance charges must be prepaid by the user.
4.
If user has any questions about
service, please contact the ISD authorized service
center.
ALL OTHER EXPRESS OR IMPLIED WARRANTIES
ON THIS PRODUCT, INCLUDING THE IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE,
ARE EXPRESSLY LIMITED TO THE DURATION OF THE LIMITED
WARRANTIES SET FORTH ABOVE. Some states do not allow
limitations on how long an implied warranty lasts, so
the above limitation may not apply to user. If this product
is not in good working order as warranted above, your
sole and exclusive remedy shall be the repair or replacement
of the product at the sole discretion of ISD. In no event
shall ISD or it’s parent company or any ASP be
liable to you or any third party for any damages of any
kind, including any direct or indirect damages, lost
profits, lost savings or other special, incidental, exemplary
or consequential damages, whether for breach of contract,
tort or otherwise, or whether arising out of the use
or inability to use such product. WITH THE EXCEPTION
OF ANY WARRANTIES IMPLIED BY STATE LAW AS HEREBY LIMITED,
THE FOREGOING EXPRESS WARRANTY IS EXCLUSIVE AND IN LIEU
OF ALL OTHER WITH RESPECT TO THE REPAIR OR REPLACEMENT
OF ANY PRODUCTS OR PARTS. IN NO EVENT SHALL ISD BE LIABLE
FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. Some states
do not allow the exclusion or limitation or incidental
or consequential damages so the above limitation may
not apply to user. No person, agent, distributor, dealer,
service station or company is authorized to change, modify
or extend the terms of these warranties in any manner
whatsoever. The time within which an action must be commenced
to enforce any obligation of ISD arising under this warranty
or under any statute, or law of the United States or
any state thereof, is hereby limited to one year from
the date you discover or should have discovered, the
defect. This limitation does not apply to implied warranties
arising under state law. Some states do not permit limitation
of the time within which you may bring an action beyond
the limits provided by state law so the above provision
may not apply to user. This warranty gives the user specific
legal rights and user may also have other rights which
may vary from state to state.
